Abortion rights: Biden 'continues to support' existing case law

US President Joe Biden assured Wednesday that he “continues” to support the “ROE v. Wade", which founded the right to abortion in the United States and whose future is suspended on a decision of the Supreme Court. "I didn't see anything of the debate today," said Joe Biden, when asked about the hearing that took place a little earlier at the highest American court. “I support ROE v. Wade, I think that's the most rational position, and I continue to support it."

A majority of the justices of the Supreme Court of the United States seemed on Wednesday tempted to modify the legal framework which, for nearly 50 years, has guaranteed the right of American women to have an abortion, either by restricting it or by nullifying it altogether and simply. The nine wise men, including six conservatives, spent two hours examining a Mississippi law that prohibits abortions after 15 weeks of pregnancy. White House spokeswoman Jen Psaki said that according to the president, "Mississippi's law blatantly violates women's constitutional rights to have legal and safe abortions." This is a "serious threat to the fundamental rights of women", she added.

The president “is committed to working with Congress to codify this constitutional right to a legal and safe abortion,” she recalled. The right to abortion in the United States is not guaranteed by federal law, but is based on case law, in this case on a landmark judgment of the Supreme Court, “ROE v. Wade” of 1973. In this judgment, she considered that the Constitution guaranteed the right of women to have an abortion and that the States could not deprive them of it. In 1992, she specified that this right was valid as long as the fetus is not “viable”, that is to say around 22 to 24 weeks of pregnancy.
